1. Acceptance of Terms
By accessing or using the FREAKS.ONE website, smart contract, Discord bot, or any associated services (collectively, the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.
2. Description of the Collection
FREAKS.ONE is a generative NFT collection of 10,000 unique digital tokens deployed on the Ethereum blockchain. The smart contract address is 0x31Bc50C6B4B98893fD5f619Af217dBE0caAb234B.
Each token is generated deterministically from a seed and is identified as a unique ERC-721 asset. Ten (10) tokens are designated as special 1/1 pieces.
3. What You Own
When you acquire a FREAKS NFT, you own the ERC-721 token recorded on the Ethereum blockchain. Ownership of a token grants you:
- Full ownership and right to transfer or sell the token.
- A personal, non-exclusive license to display the associated artwork for personal, non-commercial use. This license transfers automatically with the token upon sale or transfer.
- Access to holder-gated features on the Platform for as long as the token is in your wallet.
Ownership of a token does not grant you intellectual property rights over the FREAKS.ONE brand, name, visual identity, or codebase. You may not use the artwork for commercial purposes without explicit written permission.
4. Not an Investment
FREAKS NFTs are digital collectibles intended for personal enjoyment and participation in the project ecosystem. Nothing on this Platform constitutes financial advice or an offer of securities. We make no representations or warranties regarding the future value of any token. Acquiring a FREAKS NFT carries risk, including the risk of total loss of value. You are solely responsible for your own decisions.
5. Smart Contract Risks
The FREAKS smart contract is deployed on the Ethereum blockchain and is immutable. Once deployed, it cannot be modified or reversed. By interacting with it, you acknowledge and accept the following risks:
- Smart contracts may contain bugs or vulnerabilities.
- Blockchain transactions are irreversible.
- Gas fees and network conditions are outside our control.
- We are not responsible for losses resulting from blockchain errors, wallet compromise, or user error.
6. Platform Use
You agree to use the Platform only for lawful purposes. You may not:
- Attempt to reverse-engineer, exploit, or attack any component of the Platform.
- Use automated scripts or bots to interact with the website or API without authorization.
- Impersonate other users or misrepresent your identity or token ownership.
- Use the Platform to engage in any activity that violates applicable law.
7. Limitation of Liability
To the fullest extent permitted by applicable law, FREAKS.ONE and its operators shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of tokens, loss of data, or financial loss.
8. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
9. Governing Law
These Terms are governed by the laws of Italy and the European Union. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Italy.
